LEGAL WARRANTY

Apple products and all products purchased from Apple, including non-Apple branded products, are covered by a 2-year legal warranty for lack of conformity, under the terms of the Guarantees Law (Decree-Law no. 67/2003, amended by Decree-Laws no. 84/2008 and no. 84/2021 of October 18th).

According to the Guarantees Law, consumers have the right to obtain from the seller, as well as, if the legal requirements are met, from the producer, the repair or replacement of products, free of charge and without any charge, when a defect compliance is manifested within 3 years from the date of delivery. Within this 3-year period, consumers can also, free of charge, choose to ask the seller for an appropriate price reduction or termination of the contract. Consumers may exercise any of the rights mentioned above against the seller, except when this proves impossible or constitutes an abuse of rights, in general terms. Without prejudice to their rights vis-à-vis the seller, consumers may choose to demand repair or replacement of products directly from the producer, unless this proves impossible or disproportionate. Consumers must report the defect to the seller within 2 months from the date on which the defect was detected.

EXPLANATORY NOTE ABOUT THE CONDITIONS FOR REQUESTING/OBTAINING LEGAL WARRANTY REMEDIES

1 . Who is likely to benefit from the legal rights enshrined in the Guarantees Law?

Only consumers - ie, individual people to whom goods are supplied, services rendered or any rights transferred, intended for non-professional use, by a person who professionally carries out an economic activity aimed at obtaining benefits - can benefit from the legal guarantee. In this way, the products purchased and which are described in a

invoice, indicating the VAT registration number of a company or professional, are not likely to benefit from the Guarantees Law regime.

two . How/when is it possible to request the solutions contained in the legal guarantee?

According to the Guarantees Law, consumers have the right to obtain from the seller, as well as, if the legal requirements are met, from the producer, the repair or replacement of products, free of charge and without any charge, when a defect compliance is manifested within 2 years from the date of delivery. Consumers can exercise their legal guarantee rights, as long as they provide proof of purchase of the product (e.g. receipt/invoice). Therefore, it is important to always keep the proof of purchase document relating to the product in question.

3 . What is a lack of conformity?
As stipulated in article 2 of the Guarantees Law, products are presumed to have a

lack of conformity if any of the following occurs:

(i) They do not comply with the description made by the seller or do not have the qualities of the good that the seller has presented to the consumer as a sample or model;

(ii) They are not suitable for the specific use for which the consumer intended them and of which he informed the seller when he signed the contract and which he accepted;

(iii) They are not suitable for the uses normally given to goods of the same type;

(iv) They do not present the qualities and performance that are usual in goods of the same type and that the consumer can reasonably expect, taking into account the nature of the good and, possibly, public statements about its specific characteristics made by the seller, the producer or their representative, particularly in advertising or labeling.

In accordance with the Guarantees Law, any lack of conformity, which manifests itself within a period of 2 years from the date of delivery of the product, is presumed to already exist on the date of delivery, except when this presumption is incompatible with the nature of the product. product or with the characteristics of lack of conformity.

If the product or part of the product has been replaced, the replacement product has a new warranty period of 2 years, counting from the date of delivery.

The 2-year period is suspended, from the date of reporting the defect to the seller (or the producer), during the period in which the consumer is deprived of the use of the product because the situation is being resolved.

4. What to do when the product purchased from the Apple Online Store has a lack of conformity?

If the consumer finds that a product purchased from the Apple Online Store has a lack of conformity, he/she may contact the Apple contact center using the telephone number indicated below.

The Apple contact center will analyze the detected problem according to points 1 to 3 above. If the problem cannot be resolved over the telephone and/or if, to verify whether there is an actual lack of conformity, a technical diagnosis is necessary, the consumer will be redirected to an Apple Authorized Service Provider ("PSAA").

In cases where a lack of conformity is confirmed, in accordance with points 1, 2 and 3 above, the consumer will be entitled to obtain from Apple a free repair or replacement of the defective product, an appropriate price reduction or termination of the contract. , free of charge. The consumer may choose to exercise any of these rights, unless this proves impossible or constitutes a clear abuse of rights, in accordance with the general rules of law.

Note: The above rights only apply to products that were purchased from the Apple Online Store by a consumer in Portugal.

5 . What should I do when a product that was not purchased from the Apple Online Store has a lack of conformity?

Consumers who buy Apple products in Portugal can request the benefits of the legal guarantee from the direct seller of the product, as long as the conditions established in the Guarantee Law are met.

Consumers can also direct their repair or replacement requests to Apple, as the manufacturer, by contacting the Apple Contact Center via the

telephone number indicated below. Apple contact details are also set out at the following link http://www.apple.com/contact.

Apple's customer support center will review the detected issue in accordance with points 1 to 3 above. If the problem cannot be resolved over the telephone and/or if, to verify whether an actual conformity defect exists, a technical diagnosis is necessary, the consumer will be redirected to an Apple Authorized Service Provider ("PSAA").

In cases where a lack of conformity is confirmed, in accordance with points 1, 2 and 3 above, the consumer will be entitled to obtain free repair or replacement of the defective product from Apple, free of charge, unless:

(i) is impossible or disproportionate, taking into account the value that the product would have if the lack of conformity did not exist, the importance of the lack of conformity, and the possibility of the alternative solution being implemented without serious inconvenience to the consumer, or

(ii) Apple proves that (1) the lack of conformity derives exclusively from the seller's statements about the product and its use or misuse, (2) it did not put the product into circulation, (3) the defect did not exist in the at the time the product was put into circulation (4) the product was not manufactured for sale or any other form of distribution for profit or was not manufactured or distributed as part of Apple's business, or (5) more than 10 years have passed since the product was put into circulation.

6. Examination, assistance and associated costs

In cases where a product purchased from the Apple Online Store is reviewed by a PSAA, the consumer receives a receipt with a unique claim number. When the consumer contacts the PSAA to check the status of the complaint, they can use this number which will identify them and the product being examined.

If the examination of the product reveals that there is a lack of conformity (as described in point 3 above ), the consumer will be informed of the estimated time for repair, which should not exceed 30 days.

If it results from the examination carried out that the product does not present a lack of conformity (as described in point 3 above ) - for example, if the defect is a consequence of misuse or abusive use of the product by the consumer -, the PSAA will contact the consumer to inform him/her about the nature of the defect, as well as the estimated costs for the service.

If the Guarantees Law does not apply, the PSAA will submit the estimated price for the service costs for consumer approval before the service begins.

When a consumer requests technical support from Apple for a product that does not have a lack of conformity, Apple will inform the consumer of the technical support costs, which cost will be borne in full by the consumer.
